DMCA Policy

This Digital Millennium Copyright Act (“DMCA”) Policy applies to all content and services provided by Lumiere Networks, including but not limited to our proxy infrastructure, web hosting, and content delivery network (CDN) services. Lumiere Networks is committed to responding promptly to valid claims of copyright infringement in compliance with the United States Digital Millennium Copyright Act of 1998.

1. Designated Agent

If you believe that your copyrighted material has been copied or distributed via our services in a way that constitutes copyright infringement, please send a written notification to our designated agent at:

2. Requirements of a Proper DMCA Notice

Your DMCA notification must include the following elements, as required under 17 U.S.C. § 512(c)(3):

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, including URLs or specific server paths, so we can locate it
• Your contact information (name, address, phone number, and email address)
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner

3. Counter-Notification Process

If you believe that the content removed or disabled as a result of a DMCA notice was done so in error or was misidentified, you may file a counter-notification. To be effective under the DMCA, a counter-notice must include:

• Your physical or electronic signature
• Identification of the material that has been removed or to which access has been disabled and the location at which it appeared before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or the Republic of Nicaragua, if outside the U.S.)
• A statement that you will accept service of process from the person who provided the original DMCA notification or their agent

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Lumiere Networks may, in appropriate circumstances, terminate users who are repeat infringers. We reserve the right to take this action at our sole discretion and without notice.

5. Disclaimer

Lumiere Networks operates as a proxy platform and CDN service provider. We do not host or control the content of third-party VPNs or websites using our infrastructure. However, we will act upon valid DMCA takedown notices directed at content accessible through our network or systems, where applicable.
